Important Notice

This Acceptable Use Policy outlines the prohibited uses of the ProfitMaster service. Violations of this policy may result in immediate suspension or termination of your account. By using the Service, you agree to comply with this policy and our Terms and Conditions.

1. Purpose and Scope

This Acceptable Use Policy (“AUP”) governs your use of MOONSHIFT LLC's services, operating as ProfitMaster (“Service”). The purpose of this AUP is to ensure the Service is used in a lawful, ethical, and responsible manner that does not harm ProfitMaster, our users, or third parties.

This AUP applies to all users of the Service, including:

  • Individual account holders
  • Business and enterprise customers
  • Authorized users accessing accounts on behalf of organizations
  • Trial users and free account holders

This AUP supplements and is incorporated into our Terms and Conditions. In the event of any conflict between this AUP and the Terms and Conditions, the Terms and Conditions shall prevail.

2. Acceptable Uses

ProfitMaster is designed to help Shopify merchants track, analyze, and optimize their e-commerce business performance. Acceptable uses of the Service include:

  • Connecting legitimate Shopify stores that you own or have authorization to manage
  • Integrating advertising accounts (Facebook Ads, Google Ads) that you own or are authorized to access
  • Analyzing business metrics, profit data, and performance analytics for your own business purposes
  • Generating reports and insights for internal business decision-making
  • Exporting your own data for backup or analysis purposes
  • Using the Service in accordance with all applicable laws, regulations, and this AUP

3. Prohibited Uses

You agree not to use the Service for any of the following prohibited purposes:

3.1 Illegal Activities

You may not use the Service to:

  • Engage in any activity that violates any applicable federal, state, local, or international law or regulation
  • Facilitate money laundering, terrorist financing, or other financial crimes
  • Sell or promote illegal products, services, or content
  • Violate export control laws or sanctions regulations
  • Engage in fraud, misrepresentation, or deceptive practices
  • Infringe upon or violate any third party's legal rights
  • Promote, facilitate, or engage in illegal gambling or pyramid schemes

3.2 Intellectual Property Violations

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service or its software
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Use ProfitMaster's trademarks, logos, or branding without express written permission
  • Create derivative works based on the Service
  • Use the Service to infringe on the intellectual property rights of others
  • Upload or transmit content that infringes on patents, trademarks, copyrights, or trade secrets

3.3 Unauthorized Access and Security Violations

You may not:

  • Access or attempt to access accounts, systems, or data that you are not authorized to access
  • Probe, scan, or test the vulnerability of any system or network
  • Breach or circumvent any authentication, security, or access control measures
  • Use automated means (bots, scrapers, crawlers) to access the Service without permission
  • Interfere with or disrupt the integrity or performance of the Service or related systems
  • Attempt to gain unauthorized access to the Service, accounts, systems, or networks
  • Intercept, monitor, or alter data or communications not intended for you
  • Distribute viruses, malware, ransomware, trojan horses, or other harmful code
  • Engage in any form of denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks
  • Share your account credentials with unauthorized third parties

3.4 Data Misuse and Privacy Violations

You may not:

  • Access, use, or process data from Shopify stores or advertising accounts you do not own or are not authorized to access
  • Collect, harvest, or scrape personal information about other users without their consent
  • Violate any individual's privacy rights or data protection laws (GDPR, CCPA, etc.)
  • Use the Service to track, monitor, or surveil individuals without their knowledge or consent
  • Sell, share, or disclose customer data obtained through the Service to unauthorized third parties
  • Use customer data for purposes other than those disclosed to the data subjects
  • Store or process sensitive personal information (health records, financial data, etc.) without appropriate security measures
  • Fail to comply with applicable data protection and privacy laws when using the Service

3.5 Spam and Unsolicited Communications

You may not:

  • Send unsolicited bulk emails, messages, or communications (spam)
  • Use the Service to conduct phishing attacks or distribute malicious links
  • Send communications that violate CAN-SPAM Act, GDPR, or other anti-spam laws
  • Harvest email addresses or other contact information for spamming purposes
  • Engage in chain letters, pyramid schemes, or multi-level marketing through the Service
  • Impersonate ProfitMaster or send communications that falsely appear to be from us

3.6 Abusive and Harmful Behavior

You may not use the Service to:

  • Harass, threaten, intimidate, or abuse other users or ProfitMaster personnel
  • Post or transmit hateful, discriminatory, or offensive content
  • Promote violence, self-harm, or harm to others
  • Engage in cyberbullying or stalking
  • Publish or distribute content that is defamatory, libelous, or slanderous
  • Engage in hate speech or promote discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

3.7 Competitive and Commercial Misuse

You may not:

  • Use the Service to develop, build, or operate a competing product or service
  • Perform competitive analysis, benchmarking, or reverse engineering for commercial advantage
  • Resell, sublicense, or redistribute access to the Service without written authorization
  • Use the Service on behalf of multiple clients in a commercial capacity (e.g., agencies) without an appropriate enterprise agreement
  • Frame or mirror any part of the Service on another website
  • Use the Service to aggregate, compile, or create databases for commercial sale or distribution

3.8 System Abuse and Resource Exploitation

You may not:

  • Exceed usage limits specified in your subscription plan or documentation
  • Use the Service in a manner that places unreasonable load on our infrastructure
  • Attempt to overwhelm or crash the Service through excessive requests or traffic
  • Use automated scripts or bots to create accounts or generate artificial traffic
  • Exploit any bugs, glitches, or vulnerabilities for personal gain
  • Use the Service to mine cryptocurrency or perform distributed computing tasks
  • Access the Service using multiple accounts to circumvent usage limits or restrictions

3.9 Misrepresentation and Impersonation

You may not:

  • Provide false, inaccurate, or misleading information when registering or using the Service
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Use someone else's account, credentials, or data without authorization
  • Create fake or misleading accounts or profiles
  • Misrepresent your relationship with Shopify stores or advertising accounts you connect

3.10 Third-Party Service Violations

You may not:

  • Use the Service in a manner that violates the terms of service of integrated third-party platforms (Shopify, Facebook, Google)
  • Access third-party APIs through ProfitMaster in violation of their terms or rate limits
  • Use the Service to circumvent restrictions or limitations imposed by third-party services
  • Violate the advertising policies of Facebook Ads or Google Ads when using our integrations

4. Enforcement and Consequences

4.1 Monitoring and Investigation

ProfitMaster reserves the right to:

  • Monitor use of the Service for compliance with this AUP and our Terms and Conditions
  • Investigate suspected violations of this AUP
  • Review account activity, logs, and usage patterns
  • Cooperate with law enforcement agencies in investigating illegal activities
  • Disclose information to law enforcement or regulatory authorities as required by law

We do not actively monitor all user activity, but we use automated systems and may conduct manual reviews to detect violations.

4.2 Sanctions for Violations

If we determine that you have violated this AUP, we may take one or more of the following actions:

a) Warning

For minor or first-time violations, we may issue a formal warning and require you to cease the prohibited activity immediately. You will be given an opportunity to correct the violation.

b) Temporary Suspension

For moderate violations or repeated minor violations, we may temporarily suspend your access to the Service for a specified period (typically 7-30 days). During suspension, you will not have access to the Service but your data will be retained.

c) Permanent Termination

For serious violations, repeated violations, or illegal activities, we may permanently terminate your account and access to the Service without prior notice. You will not be entitled to a refund of any prepaid fees.

d) Legal Action

For violations involving illegal activity, we reserve the right to pursue legal remedies, including civil litigation and criminal prosecution. We may report violations to law enforcement authorities.

e) Financial Penalties

You may be held liable for damages resulting from your violations, including costs incurred by ProfitMaster to investigate and remediate the violation, legal fees, and damages to third parties.

4.3 No Refunds for Policy Violations

If your account is suspended or terminated for violating this AUP, you will not be entitled to any refund of subscription fees, and we may seek to recover additional costs and damages resulting from your violation.

4.4 Account Reinstatement

If your account has been suspended (not permanently terminated), you may request reinstatement by:

  • Contacting our support team at contact@profit-master.io
  • Providing a detailed explanation of the steps you have taken to correct the violation
  • Agreeing to comply with this AUP and our Terms and Conditions going forward
  • Cooperating with any investigation or verification process

Reinstatement is at our sole discretion. We may impose additional conditions or restrictions on reinstated accounts.

5. Reporting Violations and Abuse

5.1 How to Report Violations

If you become aware of any violations of this AUP or suspect abusive behavior, please report it to us immediately:

  • Include: Detailed description of the violation, supporting evidence (screenshots, logs, URLs), date and time of incident, any other relevant information

5.2 Response to Reports

When you submit a report:

  • We will acknowledge receipt of your report within 2-3 business days
  • We will investigate the reported violation
  • We will take appropriate action based on our findings
  • We may contact you for additional information or clarification
  • For privacy and security reasons, we may not disclose the outcome of our investigation or actions taken

5.3 False Reports

Submitting false, misleading, or malicious reports is itself a violation of this AUP and may result in action against your account. Please ensure your reports are accurate and made in good faith.

6. Indemnification for Violations

You agree to indemnify, defend, and hold harmless ProfitMaster, its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of this AUP
  • Your misuse of the Service
  • Your violation of any rights of another party, including intellectual property rights
  • Your violation of any applicable laws or regulations
  • Any content or data you provide to the Service

7. Cooperation with Law Enforcement

ProfitMaster will cooperate with law enforcement authorities in investigating suspected illegal activities. This may include:

  • Providing user information, account data, and activity logs in response to valid legal requests
  • Preserving evidence and data related to investigations
  • Proactively reporting suspected criminal activity to appropriate authorities
  • Complying with subpoenas, court orders, and legal process

We may disclose information without prior notice to you if required by law or if we believe such disclosure is necessary to prevent harm or illegal activity.

8. User Responsibilities

As a user of the Service, you are responsible for:

  • Familiarizing yourself with and complying with this AUP and all applicable laws
  • Ensuring that your use of the Service does not violate the rights of others
  • Securing your account and protecting your login credentials
  • Monitoring activity on your account and reporting any unauthorized access
  • Ensuring that authorized users of your account comply with this AUP
  • Promptly reporting any violations or security issues you discover
  • Keeping your contact information current so we can reach you regarding policy matters

9. Third-Party Compliance

When using integrated third-party services through ProfitMaster, you must comply with their terms of service and policies:

Violations of third-party terms may result in action against your ProfitMaster account, in addition to any action taken by the third-party service.

10. Modifications to This Policy

We reserve the right to modify this Acceptable Use Policy at any time. When we make changes:

  • We will update the “Last Updated” date at the top of this page
  • For material changes, we will provide notice via email or through the Service
  • Changes will take effect immediately upon posting for new users
  • For existing users, changes will take effect 30 days after notice is provided
  • Your continued use of the Service after changes take effect constitutes acceptance of the updated policy

If you do not agree to the modified AUP, you must stop using the Service and cancel your account.

11. Severability

If any provision of this AUP is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the extent necessary to make it valid and enforceable while preserving its intent.
